WHAT WE CANNOT DO As much as we would like to help everyone who contacts us, there will be sometimes when we cannot. For example, lawyers do have to comply with RULES OF PROFESSIONAL CONDUCT. One such rule prohibits lawyers from representing one client who's interest is directly adverse to those of another. Obviously, if we have already assisted someone with filing a trademark or copyright application and you want to file something that infringes or dilutes the other client's mark, or infringes a copyright, then we cannot take your case. Therefore, we must conduct a check against our client list prior to starting any work for you in order to determine whether a conflict exists and whether the conflict can be resolved. If the conflict cannot be resolved, then we will not be able to provide you with assistance. We will notify you promptly so that you can make other arrangements. Likewise, if you have advanced any funds or provided us with any property, it will be promptly returned. Conflicts can also arise where companies or partnerships break up and the principal owners are now adverse to each other. If such happens and the former company or partnership was a client, then we may not be able to represent either party and will have to terminate the relationship. Again, any property or funds advanced to us will be returned. We do not handle patent matters. Patents are a different type of intellectual property covering protection for inventions and processes which require someone with expertise in patent law and admission to the Patent Bar. If you have patent matters, we can provide you a referral to someone who can assist you. Although we can handle your U.S. Trademark filings and UDRP cases no matter where you or your business is located, we may not be able to take on representation in civil suits in states other than Texas, Arkansas, or Tennessee. If it turns out that we can not assist you in your lawsuit, we will try to provide you a referral to someone who can. |
